a cheating scandal rocks the air force. dozens of officers charged with manning the nation's nuclear arsenal are relieved from duty following allegations of cheating on proficiency exams. a senate panel releases its findings on the deadly attack on the u.s. consulate in benghazi and says the assault could have been prevented. and officials release their game plan for keeping this year's super bowl safe. football fans are told to expect airport-style screening before entering the big game. captioning funded by cbs this is the "cbs morning news" for thursday, january 16th, 2013. good morning. good to be with you. i'm anne-marie green. well, next week the secretary of the air force deborah lee james, will personally inspect the

nation's three nuclear missile bases. she's investigating what may be the worst cheating scandal in the history of america's nuclear missile force. a group of launch officer at montana's malmstrom air force base is allegedly involved or has knowledge of cheating on a proficiency exam. susan mcginnis is in washington. susan, good morning. >> good morning, anne-marie. 34 airmen who are in focus here are in charge of maintaining and operating this nation's nuclear missile. now, the test they were taking was to assess their knowledge of how to operate nuclear warheads. it's being called a huge breach of integrity. 34 air force officers responsible for the deadliest weapons in the world have been pulled off the job for their roles in an alleged cheating scandal. >> this is absolutely unacceptable behavior. >> pentagon officials say in september a launch officer at malmstrom air fort base in montana allegedly texted other officers' answers to a monthly

proficiency test. >> some officers did it. others apparently knew about it, and it appears they did nothing or at least not enough to stop it or to report it. >> the officers have been relieved from missile crew c security and their duties suspended. the chief say it has more do with lack of integrity than a lapse of knowledge. >> it's hard to cover up confidence in cheating when you're going have a monthly simulator with two instructors actually watch you conduct practical production. you can't hide that. >> the can zal appears to be isolated to the malmstrom base. >> they have to look at commanders two levels up to see what would make them think could get away with it. >> reporter: every launch officer in the air force is being tested this week. now, the cheating scandal came to light during a drug investigation that involves 11 officers, two of them among this -- involved in this cheating scandal. the pentagon says that they are

accused, they are expected of possession recreational drugs. anne-marie? >> susan mcginnis in washington. thank you, susan. the alleged cheating scandal is the latest to beset it. last spring 17 launch officers at minot base in north dakota were suspended for poor performance and bad attitudes. in august an entire wing in malmstrom failed a security inspecti inspection. and in october some were fired in the midst of an alcohol-related complaint. this morning a navy fighter pilot is in critical condition after his plane crashed in the atlantic ocean. the jet, an f/a-18 super hornet crashed 18 miles off virginia beach. the pilot was able to eject before the crash and made it to a life craft. he was picked up by a fisherman

picked up by a navy helicopter and flown to a norfolk hospital. a report from the senate intelligence committee says the deadly attack on the u.s. mission in benghazi, libya, could have been avoided. it involves the intelligence community, the state department, and even ambassador chris stevens who was killed in the attack. on two occasions stevens refused an off for more security. nancy cordes reports. >> reporter: the senate intelligence committee handles documents so sensitive it holds its hearings behind closed doors. after reviewing the documents from the benghazi attack for 15 months, they found ample warning that the security situation in eastern libya was deteriorating. their report finds there were at least 20 security incidents against foreign erps in benghazi in the months leading up to the 2012 assault including an ied attack that blew a large hole in the u.s. compound's exterior wall. it all led the intelligence

defense agency in june 2012. we expect more anti-u.s. terrorist attacks in eastern libya including more ambush and ied attacks. the pentagon agreed the attacks would increase. >> was the analysis accurate. the answer is yes. >> reporter: california democrat dianne feinstein chairs the intelligence committee. why do you think that the state department didn't beef up security at the compound or close the compound in the face of all of these warnings? >> i can only say that it should have happened. i won't speculate because i don't know. it should have happened. >> reporter: georgia's saxby chambliss is the committee's top republican. >> certainly knew enough to know that we should not leave americans exposed in an area such as benghazi that has a history of violence and where the potential for an attack to occur was present.

>> reporter: the state department points out there was no intelligence pointing to this specific attack, which involved up to 60 assailants, and they say they are already implementing many of the security recommendations made in this report by the intelligence committee. nancy cordes, cbs news, capitol hill. a new video of the only prisoner of war shows bowe bergdahl in declining health. he was taken prisoner on june 30th, 2009. it's believed he is being held in pakistan. u.s. officials learned of the video several days ago. bergdahl's family issued a statement asking the taliban to free him. and president obama is expected to outline reforms to the government's secret surveillance programs friday. sources tell cbs news he will preserve most of the current surveillance technology and tactics but president obama will add greater oversight including a privacy advocate and he will require high-level approval for snooping on foreign heads of state.

a gunman walked into a northern indiana grocery store and opened fire. he shot and killed two people before police killed him. police were called to the market in elkhart late last night. the gunman used a semiautomatic weapon to kill two women. one victim was an employee, the other a shopper. he was aiming at a third person when the police arrived. and police in new mexico say the 12-year-old boy who opened fire on tuesday planned the attack. they say he warned some classmates before the shooting. the boy's parents and grandparents issued a statement. his whole family is heartbroken. they say we'll cooperate with the law enforcement in all ways. crystal gutierrez of our albuquerque affiliate krue reports. >> 911, what's your emergency? what's going on? >> ma'am? ma'am, is there anyone here? someone just got shot. >> reporter: a chilling call from a student inside berrendo

middle school. in the back grond kids screaming, crying, asking, where is help after a 12-year-old opened fire shooting two students. this would be the beginning of a flood of 911 calls tuesday morning. >> 911, state your emergency. >> i got a call from my daughter at berrendo middle school, a text. she's crying. she says there's someone at the school with a gun. >> i'm a parent and have children at berrendo middle school. was there really a shooting there? >> yes, ma'am. >> reporter: while parents were wondering what was going on inside the school, students who were there described what they saw to dispatchers. >> a shotgun. someone walked in with a shotgun and just shot. a person just got shot. >> where's the person? >> we're in the middle school. the big gym. >> you know that one person's been shot? >> yeah, i saw him. i saw him. you probably need to hurry though. >> we're hurrying. trust me, we're hurrying. >> reporter: a school employee also called for help as she comforted a 13-year-old who was shot.

and 23 grams of whole grain in the breakfast power sandwich. last july a chinese girl survived a plane crash in san francisco only to be run over and killed by first responders. new video shot by firefighters shows what happens. as anna werner reports, her family filed claim against the city. >> there's essentially two large openings. one in the middle of the fuselage and one in the front of the fuselage. >> reporter: the truck and helmet cam videos show firefighters risked their lives to get near and inside the burning plane. >> it's the only opening here. >> reporter: several climbed up the jet's emergency slides to reach for passengers, but as with any disaster, there was confusion. >> hey, hey. that's what i'm telling you, man. i want you to walk over there. that's what they're there for.

do not come over here again. >> reporter: some firefighters saw the 16-year-old ye meng yuan near the wreckage but assumed she was dead. the coroner says ye survived the crash but was actually killed by a fire truck that ran her over. >> oh, my god. >> reporter: a summary of interviews conducted by the national transportation safety board shows one airport safety officer described firefighters as all jockeying for position and looking at the fire, not at what was outside their vehicle. san francisco fire department protocol say the dead may be left in place but must be labeled as deceased. it's not clear from the video if ye was marked before she was run over. assistant deputy fire chief dale carnes told the ntsb there was no industry standard as to how to mark bodies of victims, but the didn't's safety plan does call for spotters to help

here's a look at today's forecast in some cities around the country. new york, cloudy today, a high of 43. miami will be sunny. snow in chicago, and sunshine in dallas and los angeles. 85 the high in l.a. on the "cbs moneywatch" now, jcpenney cuts thousands of jobs, and hershey's lets you spread the chocolate cheer. wendy gillette is at the new york stock exchange with that and more. good morning, wendy. >> good morning, anne-marie. the struggling department store chain jcpenney says it's closing 33 stores nationwide. it will cost thousands their jobs. the stores will be closed by early may. the cuts are expecting to save

penny's $65 million annually. asian stocks were mixed on a weaker yen. tokyo's nikkei lost more than a quarter percent. hong kong e hong kong's hang seng added a quarter percent. some strong earnings reports sent stocks on wall street higher. the dow jones industrial climbed 108 points. the nasdaq composite finished the day nearly 32 points higher. the national labor relations board filed complaints against walmart for violating the rights of protesting and striking workers. federal officials say walmart illegally fired, disciplined, or threatened more than 60 employees in 14 states last year. if walmart is found liable, it could be required to reinstate the workers with backpay. good news for parents if your child has purchased without your permission a bobo app using an iphone or ipad, apple will refund their money. apple cut a deal with the federal trade commission to pay back at least $32.5 million.

washington, d.c., will be sunny today with a high of 44. sunshine and 44 in atlanta as well. but snow in st. louis, sun in denver, and seattle will be cloudy today. there will be a massive security presence at super bowl xlviii. nearly 4,000 local police and private security officers will be working the big game. 80,000 fans are expected to pour into metlife stadium on february 2nd. >> as fans arrive on game day, they should plan for entry screening that will be very similar to what they experience at an airport. we will utilize walk-through metal detectors, hand-held metal detector, pat-down searches, and canine teams, and x-ray equipment. >> the nfl is urging fans not to bring bags to the stadium. at least 100 government agencies are involved in the effort. they offered no estimate on the

cost. in baseball los angeles dodgers ace clayton kershaw has agreed to one of the richest deals in major league history. the left-hander will be paid $215 million over seven years. that makes kershaw the first player to earn an average of $30 million a year. kershaw has already won two cy young awards before his 26th birthday. and the miami heat find themselves in a bit of a rough patch. the two-time defending champs are now losers of three in a row. washington goes on a 20-point run in the first quarter and never looks back. the wizards win, 114-97. finally the wife of miami dolphins quarterback ryan tannehill left an assault rifle in the back of a rental care. the next person to rent the car discovered the ar-15 stowed away in a case. she turned the gun over to police. the rifle belongs to lauren tannehill. she swapped the suv hours after she rented it at a ft. lauderdale airport.

a celebration of survival wednesday on new york's hudson river. passengers and crew toasted the miracle on the hudson five years after the us airways jet splashed down safely. the flight with 155 people aboard had just taken off from laguardia airport when a flock of geese disabled the engines. captain sully sullenberger guided the plane to safety. well, here's another look at this morning's top stories. the scandal is growing. the air force removed 34 missile launch officers. they are accused of cheating or allowing others to cheat on routine proficiency tests. and a senate report says the 2012 attack on the diplomatic post in benghazi, libya, could have been prevented. it blames the state department,

the military, and intelligence, and says ambassador chris stevens reject an offer of military security. he was one of four americans killed. on wednesday, a magnitude 4.4 earthquake hit east los angeles. it struck on the same day the mayor announced a new effort to make l.a. safer from earthquakes. ben tracy reports. >> reporter: the post-recession building boom in hollywood is on shaky ground. construction in the area prompted the california geological survey to release this new map of the hollywood fault line. it appears to run under at least two proposed new towers. >> a building built across it gets ripped in half. can't be stopped. >> reporter: lucy jones is a government seismologist. >> and please welcome dr. lucy jones. >> reporter: this week she was named the new earthquake adviser for los angeles. so when we're building on the faults or near these faults, are we being willfully ignorant or just ignorant? >> we have to accept building near the fault because otherwise we give up on los angeles. there are over 100 faults in l.a.

you can't get more than ten miles away from a fault if you live in the los angeles area. >> reporter: the fault that caused the 1994 north ridge earthquake was unknown to scientists. now earthquake geologists such as james dolan have met more than 300 faults in southern california. >> the problem here is not the science. it's the implementation of the science and getting it into public policy. >> reporter: billions have been spent retrofitting highways and overpasses, and building codes are stricter, yet thousands of older buildings still need to be reinforced, communication systems upgraded, and water supplies secured. >> and what's really at stake is the future of los angeles as a city that people want to live in. >> reporter: joan says the odds of a north ridge science or larger quake in the next 30 years is 99.9%. ben tracy, cbs news, los angeles. well, coming up after your local news on "cbs this morning," details on the latest investigation into the benghazi attack. nancy cordes is live from capitol hill.
